Copyright Question
 
Would posting of other peoples copyrighted photos on someones personal yahoogroup without the permission of the photog be considered copyright infringement? Someone has been taking photos off RP and posting them on their personal group. I question this because one of mine showed up on it and I didn't give permission.

The short answer is yes - if you didn't give them permission, you should be able to ask them to remove the image from the group, and they should comply.

I thought so. He's got a lot of other peoples photos on there too. I might talk to lawyer about the issue. See if it's worth pursuing. Thanks

You have to think about this from a logical standpoint.

If it is used in a non-commercial way, and you are credited, to the letter of the law it is not "legal", but is it worth persuing?

What is the context of the use? What harm is this person doing?

If it is for commercial, absolutely persue it.

Also, you dont even have to get a lawyer. Contact Yahoo directly, give them a link to your infringing stuff, and tell them you with them to cease and decist using it. They will have the material pulled immediately without question.

How far you want to take it may be a matter of ego more than anything if this is a non-commercial matter.

Yeah... no point in contacting a lawyer unless they're making money off of it and you registered your work with the copyright office. If you registered your work, you could pursue financial compensation, otherwise the best you can do is tell them to remove it.

Obsessively linking to your pictures and those of others on RP to point out their many perceived flaws in an effort to compensate for some obvious personal shortcomings is not an infringement of copyright laws. It's just really, really lame.

Contacting Yahoo! is the way to go. They take copyright infringement on their Groups very seriously, especially when it comes to unauthorized use of photos. And what The Rat is doing is in definite violation of Yahoo!'s terms and agreements, and if someone pursues it, don't be surprised if they shut his Group down. It's happened before...

Not to mention the slander he's been doing about me lately. I wouldn't know anything about it except I have some friends who have brought it to my attention, basically with a "what's this all about?" perspective. Really, I don't know what it's all about. Not sure Yahoo! can do much about the slander, but unauthorized use of photos is one way Yahoo! Groups disappear overnight and without warning.

Apparently they can. I was sent a link from a friend to make a complaint about it, but I didn't bother to follow through with it. It was too much of a hassle to sign into yahoo, set up an acct or whatever. Not worth my time.

A guy having a little fun doesn't bother me. I enjoy reading his drivel and for what is worth, lately he has been giving me a few views on a handful of photos. Just one more place to have my photos displayed.

The buttmuncher has been lurking around in the forums too. What I really love though, is that he keeps saying that my latest stuff only was accepted (including my POTW) because I'm an elite member. If he has this "obsession" of what everyone posts on RP and writes on the forums here, he would know that I'm not an elite member. It's simple.....I'm just waaaaaaaaaaaay better than him ;-)

He doesn't post links anymore, he's posting an actual thumbnail, which in fact IS a photo of our work. He's not claiming they are of his own (and I already know what's going to come out of his mouth in reply to that, something like "I wouldn't claim they are my own even with a gun to my head"), but he didn't ask our permission.

13 Members. How many of those are RP guys? One of them, at least, is him. So he's got 12 members of his YahooGroup and you guys still can't let it go.

Technically, what he's doing is a copyright violation. He's taking the image from the place where the owner of the copyright took it and putting it on his page. I've had people do that in the past with a shot or two of mine and a quick e-mail asking them to take it down and replace it with a link normally works. In those cases, they may not realize they've done anything wrong. Chances are a nice e-mail to this loser won't work, especially since the moron is "aware" of this thread.
