There's a big difference between what's going on with the Flickr site in question and the example you give here. The first issue is a legal one. The posting of the photos on the Flickr account is a violation of Federal Copyright Law, and it is a well established legal principle that "ignorance of the law is not a defense." The example of the McDonalds restroom is a matter of violating a corporate policy which is of questionable legality in the first place, but certainly not a violation of the law.
