This guy is apparently going after other photogs on flickr as well. I have a friend who has received a copyright infringement notice and a couple nasty emails from Mr. Adams for pictures taken around the Cumberland, MD area. I rather think this guy loves the attention.

He may want to keep those; I am not a lawyer but I know some law. When I sent my notice to him; I had to swear under oath that I was the lawful owner of the photo. Sending knowingly false notices could get him in a lot of legal trouble.

I think someone needs to open up the legal flood gates on him.

Unhappy David Adams has a new Flickr account

Hey guys,

I'm new to the forum, but it seems I already have a connection with you guys, sadly, because of this nut job David Adams. I won't go into all the details, but he's been harassing me with nasty messages on my Flickr account ever since I commented on what I THOUGHT was one of his photos, but actually ended up being one of Tom Nano's photo. I made the mistake of leaving a comment on his posting, saying how crappy I thought it was that he was stealing other people's photos, and ever since I've been the happy recipient of almost daily nasty messages. Once I block him, he creates a new Flickr account and sends me new nasty messages under the new name. I've reported him to Flickr for abusive messages three time, but all I ever get back is their pat response "We're sorry, just block him."

Anyhow, this time his new Flickr user name is NECR AMTRAK CSX MASS CENTRAL6. And since May 27th he's posted quite a few photos which I'm sure are probably some of you guy's. This time, strangely enough, he has listed his email address at the top of his profile: TRAINMANIAM662@GMAIL.COM

Part of me wants to send him an angry email , but I think this guy is truly crazy enough that I need to just ignore him, especially if he does live in Bellows Falls, because he's close enough to drive to where I live South of Burlington.

Thanks,
Troy S.

Seems like he has multiple Flickr accounts now (of which the one that Troy just mentioned seems to be the "main" one: ) http://www.flickr.com/search/people/...q=NECR&m=names

And comments on his "own" photos: http://www.flickr.com/photos/7944730...in/photostream

Yep... not much to say, really.

I've received harassing messages from him on four different Flickr accounts, all very similarly named.

Default David Adam's messages- claiming death threats

Guys, this has gotten pretty serious now. I've NOT contacted or replied to David Adams at ANY of his Flickr addresses in the past several days, but tonight I got FIVE new messages from him from a brand new account:

NECR CSX AMTRAK I-91 I-89 2012

In the messages, he's once again claim copyright infringement of my photos, and they don't even have to do with trains. One of them is of my icy driveway from this winter. In the subsequent messages, he says he knows I live in Charlotte, VT and he's called The Charlotte Police, and Vermont State Police to tell them I've made death threats against me and that I'm going to be arrested. I'm going to contact the State police tonight and let them get involved now.

That sounds pretty serious Troy...hope it works out for you. If he really did call the police on you that does sound pretty wacky to me.

I made a trip to the VT state police today and took copies of all his messages and they think they may know who he is. He has NOT made any kind of false report against me, so that's a good thing. They said they would keep me informed of any developments.

This is really similar to what I went through last week with Gwennyth Patrick. The ISP number I got did turn out to be in Massachusetts.

You guys are giving this fellow far more attention than he deserves.

I know a guy in eastern Kentucky who'll burn a house down for $500. With people in it, it's just another $100. If this guy keeps bothering you, call me and I'll give you the dude's number.

Supply and demand. I think business is brisk these days, so he's doing some price gouging. It's still a bargain though...

I am a little late to this topic, But I wanted to add something.

There is a handy little tool that is called a "Digital Millennium Copyright Act Takedown Notice".

I don't know anything about flickr, but if you are the owner of an image, you can demand that flickr remove it at once.

ALL websites must comply but some may want some sort of proof that you are the owner of the image.

Facebook is where I had most of my trouble with images being stolen and represented as being a product that somebody else produces (With my watermark still on the image).

If the website does not respond, then you have other legal rights, and none of the images have to be registered to obtain real damages... But you will have to prove that you have been damaged(eg. lost income).

Maybe it is $500.00 because dwellings in Kentucky (wood shacks) are easier to burn down.

Bumping an old thread with a new related find:
One of my friends started 'sharing' photos from this Facebook page on his wall. I recognized a few of them from RP. I would assume that due to the sheer volume of photos there, that not all of the photos have permit to use statements with them. Here are the first 3 that jumped out at me from RP:

Is it just too hard for a person to link an image?

No, it's much easier to download an image, open the image in an editor, crop the image to remove the photographers name and copyright, save the image, then post it to facebook.

Facebook makes it so easy too, simply paste the link and the preview even shows up.
