I note that in the 1225 video, the shots that he has taken from RP have the copyright notice displayed. Does fair use allow for this, since youtube is a non profit site?

In his 4-8-4 video the copyright notice is not displayed for a shot that I know originally came from RP. Clearly that would be a violation of copyright.

I'm not protecting my photos for some possible commercial use. If he had bothered to ask, I would have said OK, but not asking does irritate me a little bit.

YouTube isn't non-profit - it's owned by Google and a source of ad revenue.

'Fair Use' is not determined by profit, and has never allowed the use of an entire work. From the relevant Federal code:

the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching, scholarship, or research, is not an infringement of copyright.
