Is there an exemption they can claim for not having ditch lights? From an histotrical prospective, it's good to see.

FRA Rules state that they are not required to have ditch lights as long as they don't travel over 25MPH.

Ditch lights are only required if a train operates above 20 MPH over public crossings. It is in the Code of Federal Regulations (CFR). Judging by all of the pictures I have seen of this operation, the train never exceeds 10 MPH due to track conditions.
